These Terms of Service (“Terms”) govern your use of the RackedUp mobile applications and related services operated at rackedup.app (“RackedUp,” “we,” “our,” or “us”). By creating an account or using RackedUp, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use RackedUp. If you are under 18, you represent that you have permission from a parent or guardian.
2. Your account
- You sign in with Google or Sign in with Apple. You are responsible for activity on your account.
- You may delete your account at any time from the in-app Tools screen. Deletion removes your profile and associated training data from our servers, subject to backup retention described in our Privacy Policy.
- You agree to provide accurate profile information and keep your device secure.
3. Acceptable use
You agree not to:
- Use RackedUp for any unlawful purpose or to harass, abuse, or harm others.
- Attempt to access another user’s data without authorization.
- Reverse engineer, scrape, or overload our services beyond normal app use.
- Upload malware or interfere with the integrity of the service.
4. Health and fitness disclaimer
RackedUp is a training log and progress tool. It does not provide medical advice, diagnosis, or treatment. Consult a qualified professional before starting or changing any exercise program. You assume all risks associated with physical activity. Stop exercising and seek medical attention if you experience pain, dizziness, or other concerning symptoms.
Optional integrations with Apple Health or Health Connect export workout summaries you complete in RackedUp. You control those permissions on your device.
5. Your content
You retain ownership of workout data and notes you enter. You grant us a limited license to host, process, and display that data solely to operate and improve RackedUp (for example sync, analytics shown to you, and backups).
6. Intellectual property
RackedUp’s name, branding, software, and documentation are owned by us or our licensors. These Terms do not grant you any rights to our trademarks or source code.
7. Service availability
We strive for reliable service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
8. Limitation of liability
To the fullest extent permitted by law, RackedUp and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred U.S. dollars.
9. Indemnification
You agree to indemnify and hold harmless RackedUp from claims arising from your misuse of the service or violation of these Terms.
10. Termination
You may stop using RackedUp at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.
11. Governing law
These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply.
12. Changes
We may update these Terms. We will post the revised version on this page and update the “Last updated” date. Continued use after changes constitutes acceptance.
